Lee and Grace in Virginia prevail on demurrer in legal malpractice claim

Matthew W. Lee (Of Counsel-McLean) and Kathryn Anne Grace (Associate-McLean) successfully demurred to a legal malpractice cause of action. The plaintiff was the executor of a testamentary estate and alleged that the defendant attorney had acted unreasonably in representing the decedent in a contested divorce proceeding. In particular, the decedent and her estranged husband jointly and individually held assets of approximately $5 million. The decedent, however, died prior to the completion of the divorce proceeding or the execution of an agreement as to division of the couple’s assets. As a result, the estranged husband took, by operation of law, almost all of the assets, upon the decedent’s death. More.

Lee (Associate-Los Angeles) recently prevailed in a fraud and violation of labor code matter decided in Los Angeles Superior Court.  The plaintiff alleged that her employer committed fraud and violated the labor code by refusing to pay more than $600,000 in commissions she claimed were owed to her. Takacs and Dryer of Philadelphia obtain summary judgment in a declaratory judgment action

Michael S. Takacs (Partner-Philadelphia) and Jonathan Dryer (Partner-Philadelphia) successfully obtained summary judgment in Philadelphia County, Pennsylvania, on behalf of an insurer and its Managing General Agent (MGA) in a declaratory judgment action. 

 

The plaintiff/insured owned five apartment complexes in New Jersey and one in Pennsylvania.  He sought a declaratory judgment, claiming that he was entitled to a defense and indemnification under the commercial general liability policy issued by the insurer.  More.
