Arbitration Under Attack: When Is Binding Dispute Resolution Appropriate?

Harriet Farber Klein, J.S.C. (Ret.) (Of Counsel- New Jersey) will appear as moderator of a panel at the Annual Meeting and Convention of the New Jersey State Bar Association to be held in Atlantic City, New Jersey on May 17-19, 2017. Judge Klein and four other panelists, including a justice of the New Jersey Supreme Court, will discuss the underlying law and policies that have shaped court decisions declining to compel arbitration, as well as situations in which binding dispute resolution methods may be utilized and how best to enhance the likelihood of enforcing arbitration clauses. The program will focus on distinguishing between commercial matters, where parties have provided for arbitration as part of a negotiated contract, as opposed to mandatory arbitration of consumer and employment disputes.
