Abigail Dibadj represents businesses and individuals in all aspects of civil litigation, with a focus on professional liability defense. She regularly represents law firms, attorneys, insurance agents, engineers, accountants, and other professionals in matters involving negligence, malpractice, and related claims. Through this work, Abigail has developed experience evaluating complex liability issues, managing discovery, preparing dispositive motions, and defending clients in high-stakes disputes.

Abigail also handles general liability matters involving negligence, wrongful death, construction injuries, construction defects, catastrophic loss, and other complex tort claims. She manages all phases of litigation, from pre-suit investigation and discovery through motion practice, mediation, settlement, and trial preparation.

Before joining Wilson Elser as an attorney, Abigail gained substantial litigation experience as a law clerk with the firm and with the Illinois Attorney General’s Office, where she assisted with matters involving complex legal and factual issues. She also developed regulatory and compliance experience through an internship with a global financial institution.

Drawing on her experience across professional liability, general liability, and regulatory matters, Abigail works closely with clients to develop practical, cost-effective strategies tailored to their litigation and business objectives.

Lawyers’ Liability
Abigail is part of a national team comprising more than 50 attorneys, each contributing related experience along with a keen understanding of the underlying matters at the heart of malpractice claims. Such claims can range from the most basic services to the most sophisticated, including complex securities transactions, environmental claims, intellectual property disputes, and more. Her defense of an attorney begins with an immediate and comprehensive assessment of the underlying matter as well as the malpractice claim, with a focus on early dismissal through pre-answer dispositive motions.

Security
Premises security lawsuits are among the fastest-growing segment of personal injury actions and include allegations of negligence such as failure to properly train security personnel, failure to warn against the potential for criminal activity, and negligent supervision of employees. Abigail works with risk managers and security providers to offer guidance and suggestions for claim avoidance. She helps ensure that security undertakings are duly documented and preserved and assists when a serious incident occurs, and long before a lawsuit is initiated, often meeting on short notice with appropriate personnel at the scene. She is careful to preserve witness statements, records, investigative requirements and other items essential to preparing a defense against a potential lawsuit.
