Amanda N. Harvey Partner




Amanda Harvey has more than a decade of experience handling complex and diverse litigation, representing individuals, companies and professionals at all levels in the Texas courts. Her practice has been devoted primarily to commercial litigation, catastrophic injury, cyber security, employment and labor, and premises and product liability cases. She is licensed to practice law in Texas and California, and has practiced pro hac vice in numerous jurisdictions where clients seek trial representation.

Prior to joining Wilson Elser, Amanda was an in-house litigation counsel for a major national insurance firm, where she managed an extensive litigation docket and resolved cases through alternative dispute resolution options. She also served as a judicial intern for The Honorable Barbara Rosenberg, Texas Court of Appeals, Fifth District.

Areas of Focus

Amanda’s practice includes representing national long-haul and local trucking companies in personal injury, property damage and commercial cases. Amanda routinely handles pre-suit investigations and claims that involve wrongful death and catastrophic injuries.  This experience includes representing domestic and international clients for all stages of high-exposure claims and litigation, including 24-hour emergency on-site accident response, evidentiary investigations, expert development, discovery, dispute resolution, motion practice and trial.

Data Breach Response & Defense
Amanda leads the firm’s Dallas office Cybersecurity & Data Privacy breach response team, providing 24/7 counseling to effectively and efficiently respond to data breaches while protecting each client’s business and reputation. She counsels clients through a multitude of data breach incidents impacting all types of organizations, including hospitality and health care organizations, financial institutions and professional services firms. She also advises clients on their legal notification obligations under state, federal and international laws and industry professional standards and through contractual relationships. Amanda interacts with clients’ information technology support teams and engages forensic investigators to investigate the scope and nature of an incident and help ensure that recommendations for remediation are appropriate and investigations are handled efficiently to address the threat posed to clients’ systems and data.

Commercial Litigation
Amanda has broad experience with business law. She provides innovative legal strategies and successfully litigates matters within designated time frames and budgets.  Amanda has litigated deceptive trade practices, embezzlement, fraud and contract cases, helping her clients negotiate in business disputes by guiding them past personal, business and reputational risks.

Employment Litigation
Amanda has handled numerous discrimination and harassment investigations for Texas employers.  Specifically, she has defended employers against charges of sexual harassment, gender discrimination, workers’ compensation retaliation, and violations of disability and medical leave laws. Amanda also has helped employers successfully enforce noncompetition and non-solicitation agreements.

Product Liability
Amanda understands that product liability matters often go beyond legal defense to business effects on risk management. She handles matters that extend past one court or jurisdiction, with sensitivity toward nationwide implications.  Amanda has deep experience working with and developing experts to testify at trial, as well as in developing defenses for companies new to complex litigation.  Amanda has successfully represented product manufacturers, premises owners and employers in lawsuits filed across the country involving allegations of wrongful death or serious injury.

Estate Planning and Probate
Amanda is a certified guardian ad litem, and has litigated probate matters throughout Texas.  She is also experienced in assisting clients in achieving unique planning goals by designing estate plans based on each client’s particular circumstances. Amanda understands that an important objective of this planning is to aid other family members during periods of anxiety, sadness and loss.

Representative Matters

Obtained summary judgment for a national restaurant chain in a commercial litigation dispute. 

Obtained favorable verdict for asbestos defendant in living cancer trial in Oakland, CA.

Prepared and filed amicus brief on behalf of Fortune 500 company regarding the intentional-injury exception to the exclusive-remedy provision of the Texas Workers’ Compensation Act.

Successfully briefed and argued multiple motions to dismiss and motions for partial and final summary judgment.

Obtained favorable result with a temporary injunction representing an employer with regard to a covenant not to compete.

Successfully lobbied for the "Sex Offender Registration Emergency Declaration Resolution of 1999" and against the anti-father’s provision of the Violence Against Women's Act.
