Brett understands that liability exposures increasingly drive the litigation risk profile of many U.S. and global corporations. Brett has particular experience litigating automobile manufacturer and lithium ion battery claims, design and manufacturing defects, and breaches of warranties. Brett has experience representing both commercial carriers and individual operators in transportation matters in Massachusetts and New Hampshire. He has litigated claims ranging from minor property damage, to freight charges, to wrongful death for trucking and railroad companies. Brett skillfully navigates the interplay between federal and state law for multistate companies. His experience and team of transportation attorneys allow him to focus on the small details of each case, while keeping present the reputation of national carriers.

Achieved favorable settlement and avoided excess exposure for trucking company in New Hampshire against claims of wrongful death arising out of improper maintenance and violation of DOT regulations.

Granted directed verdict on behalf of Massachusetts physicians’ organization on claims of negligent supervision; obtained appellate affirmation of judgment.

Obtained summary judgment for contractor on the basis of New Hampshire’s “borrowed servant” doctrine.

Negotiated favorable settlement for behavioral health facility on claims of alleged failure to prevent homicide.

Obtained dismissal based on lack of personal jurisdiction for hospital on breach of contract claims.
