Carole Nimaroff has extensive experience representing major U.S. and international corporations in the coordination and trial of high-stakes, complex mass-tort product liability litigations involving pharmaceutical products, medical devices and consumer products. A focus of her practice is developing and rebutting expert medical and scientific evidence and helping clients defend allegations of disease diagnosis and causation. Carole has furnished trial teams with scientific and medical defense resources, formulated medical defense strategies, and deposed hundreds of treating physicians and expert witnesses in a range of medical specialties, including cardiology, neurology, pulmonology, orthopedic surgery and gynecology.

Representative Matters

Coordinated and conducted affirmative discovery in hundreds of cases in federal and state courts on behalf of a pharmaceutical company involving a popular osteoporosis medication, most notably in a bellwether trial, winning a complete defense verdict.

Led national discovery effort in addition to expert and science defense strategy teams on behalf of pharmaceutical company involving diet drug litigation and claims of primary pulmonary hypertension; successfully eliminated all but five cases in less than three years.

Represented a U.S. tobacco company in smoking and health litigation involving claims of COPD, lung cancer and emphysema in federal and state courts in Florida.

Represented a pharmaceutical company in multimillion-dollar litigations involving claims of stroke from over-the-counter cough/cold medications, spearheading search and development of neurology experts for several trial teams.

Obtained summary judgment dismissal on behalf of a pharmaceutical company in a first-of-a-kind lawsuit alleging the transmission of mad cow disease from blood products.
