Gus Despotakis focuses his practice on banking and general commercial law. He advises and represents banks and financial institutions in connection with financial and payment systems litigation, retail and wholesale banking, and contract matters. Having spent 20 years as in-house counsel at National Westminster Bancorp, Inc. and National Westminster Bank USA (now part of Bank of America), Gus has an intimate understanding and detailed knowledge of bank products as well as bank internal functions, processes and payment systems.

Major banking institutions rely on Gus to manage national programs comprising numerous branch locations across the country. Their reliance is well-placed. Gus efficiently and effectively handles a multitude of diverse claims against banks brought by both businesses and consumers. These claims typically involve stolen and forged negotiable instruments, fraudulent or unauthorized account transactions, electronic transactions, identity theft, safe deposit boxes, cashier’s checks, and other retail and wholesale bank transactions. Gus has an especially enviable track record resolving matters that arise from negotiable instruments and funds transfers (UCC Articles 3, 4 and 4A); consumer electronic banking transactions (Regulation E); on-line banking; judgment enforcement proceedings and claims (New York CPLR Article 52); and general payment system frauds and claims (Regulation CC). His practice also includes the review and drafting of various contracts and agreements between banks and customers.

Gus frequently has presented lectures to his clients’ personnel on banking law and risk management topics.
