Daniel Lee has a diverse practice ranging from pre-litigation counseling to trial and appellate advocacy. He represents a broad array of clients ranging from large multinational companies and government agencies to small-business owners and professionals.  Daniel has successfully litigated and resolved complex business disputes, and has achieved favorable results for clients in high stakes "bet-the-company" cases.  He regularly defends employment claims, such as discrimination, harassment, breach of contract, violations of disability and leave laws, and wrongful termination. His practice includes providing advice and counsel to his clients on personnel and business matters and conducting workplace investigations. 

Daniel's engagements include the successful defense, after a two-week binding arbitration, of a multimillion-dollar claim brought against investment advisers and financial institutions; a defense jury verdict for an equipment manufacturer in an employment dispute; the favorable resolution of wage-and-hour class action matters and consumer class action matters at the pleadings stage, class certification stage and on appeal; and favorable results in claims brought against real estate firms, law firms and insurance brokers in various client and industry disputes.

Representative Matters

Defeated class claims brought against a national building-component manufacturer in a “bet the company” case and thereafter prevailed on appeal. The published appellate decision now provides favorable precedent for companies faced with class action lawsuits in California.

Defeated class claims at the pleading stage on a consumer class action case filed against a bathroom-component manufacturer.

Obtained summary judgment in a lawsuit filed by a former employee alleging that the company failed to accommodate her disability, discriminated against her and wrongfully terminated her employment.

Second-chaired a jury trial and obtained a defense verdict in a claim by a former employee for wrongful termination, unpaid wages and breach of contract.

Secured early dismissals and favorable resolution of claims brought by former employees against companies for harassment, discrimination, retaliation, wrongful termination, violation of disability and leave laws, breach of contract, and violation of wage and hour laws.

Second-chaired a FINRA arbitration and obtained a defense verdict in a customer dispute where the claimants alleged securities fraud, misconduct and sale of unsuitable products by their securities brokers.

Successful resolution of registered representatives and broker-dealers in multimillion-dollar claims filed in which claimants alleged misconduct concerning the sale of oil and real estate investments.

Successfully resolved claims for clients in the real estate, insurance, legal and construction industries.
