Dawn A. Silberstein Partner



Dawn Silberstein has more than 15 years of experience representing insurance carriers and policyholders in litigation involving third-party liability and first-party property coverage claims. She started her practice representing homeowner associations in construction defect litigation and as corporate counsel before transitioning to construction defense and then to coverage. Since joining Wilson Elser, she has expanded her practice to include defense of real estate and financial/insurance professionals.

Dawn provides aggressive, value-driven representation to all of her clients. She prioritizes clear communication throughout the litigation process with both her carrier and individual clients to ensure their understanding of potential liability, defense strategy and the litigation process. She provides a holistic approach to litigation so that clients are able to make informed decisions a every phase of the litigation regarding trial and alternative dispute resolution options.

Dawn served as an extern for the Honorable Claudia Wilkin, United States Northern District of California and as a law clerk handling disability law and international human rights matters. She also represents unaccompanied minors through immigration proceedings as part of Wilson Elser’s pro bono service.

Representative Matters

Drafted prevailing summary judgment motions in favor of insurer in two bad faith lawsuits filed by policyholder. Briefed successful opposition to policyholder’s Ninth Circuit appeal and obtained award of attorney fees for insurance carrier.

Drafted prevailing brief opposing policyholder appeal of a trial court ruling in bad faith breach of contract claim.

Briefed prevailing appeal from an adverse summary judgment ruling in an inter-carrier contribution action resulting in a published appellate decision.
