Eric P. Burns Partner




Eric Burns focuses his practice on general commercial litigation, including contract disputes and business torts; professional liability claims against lawyers and other professionals including contractors and engineers; construction defect; transportation; product liability; and complex personal injury/wrongful death matters. Eric’s diverse client roster includes national banks, insurance companies, lawyers, law firms, a regional mechanical contractor, national and regional contractors and subcontractors, and businesses of all sizes. He has significant trial and appellate experience in federal and state courts.

Eric works closely with his clients to develop and establish short- and long-term strategic goals to achieve an efficient and favorable outcome. He is recognized for his abilities in the areas of strategic planning and positioning and excels at written and courtroom advocacy. Eric is interested in further cultivating his practice in defense of professional liability claims against lawyers and engineers and expanding to include defense of directors and officers.


Representative Matters

Obtained defense verdict in favor of client law firm after 10-day legal malpractice trial in bankruptcy court where plaintiff was seeking in excess of $30 million in damages. 

Obtained defense verdicts in favor of lawyer clients in week-long jury trials in Roanoke County and Fairfax County, Virginia. 

Successfully removed and transferred case against international client to more favorable venue where we prevailed on motion to dismiss. 

Obtained summary judgment on behalf of a city jail health care provider in action brought under 42 U.S.C. § 1983. 

Successful motion to dismiss on behalf of municipality in 42 U.S.C. § 1983 matter, upheld on appeal in Fourth Circuit, with petition for certiorari denied by the Supreme Court of the United States. 

Multiple successful motions to dismiss in state and federal court in commercial and professional liability matters.
