Gary J. Spahn Jr. focuses his practice in the areas of auto liability, commercial law, construction law, first-party coverage issues and defense, general liability defense, medical malpractice, premises liability, product liability, professional liability, and third-party liability coverage and defense.

Prior to joining Wilson Elser, Gary worked at the largest women- and minority-owned law firm in the country, a full-service national law firm offering services to public and private companies, professionals, entrepreneurs and individuals. He also served as General Counsel, Soil & Water Conservation District, Orange County, Florida

In law school, Gary gained courtroom experience as a certified legal intern with the State Attorney’s Office in Orange County, Florida, and the Department of Children and Families in Seminole County, Florida. Gary clerked for a Virginia firm that focused its practice on collections and compliance with the Fair Debt Collections Practices Act.

Areas of Focus

Construction Law
Gary defends companies against allegations of liability involving property damage, catastrophic bodily injury and death, ordinance and zoning violations, and statutory violations. He has experience handling “Dig Law” violations; has successfully obtained a voluntary dismissal with prejudice at mediation; and assists insurers with liability coverage decisions and litigation arising out of the same. Gary actively defends contractors and subcontractors in construction defect matters.

Contract Law
Working with individuals and corporations, Gary prepares and reviews service and purchase contracts, drafts and enforces indemnity agreements, and litigates breach of contract disputes.

Insurance Defense
Gary defends insurers, underwriting companies and self-insureds in a variety of claims. His experience includes defending insureds, national corporations and locally owned entities against claims of automobile liability, industrial machinery liability, medical product liability, OTC supplement liability, general liability claims involving property damage, catastrophic bodily injury and death, and various other claims under different forms of insurance policies. Additionally, he assists insurers with third-party liability coverage decisions and litigation arising out of the same.

Medical Malpractice
Experienced in defending doctors, medical professionals, medical associations and hospitals against allegations of medical negligence, Gary has worked with several trial teams in representing ophthalmologists, an orthopedist, a mental health facility, a rehabilitation facility and several hospitals based on vicarious liability of their doctors and/or staff.

Premises Liability
Gary represents individuals and business entities in a wide range of premises liability claims, including slip and fall injuries, negligent security and code violations.

Product Liability
Gary defends manufacturers, distributors and retailers in complex product liability litigation against allegations of defective product design, defective manufacturing, inadequate warnings and strict liability. His litigation experience includes defending automotive companies, medical device companies, industrial machine manufacturers, household product manufactures, an OTC supplement manufacturer, and national and local retail chains. Much of his experience with product liability claims were against national or foreign corporations, allowing him to gain significant experience contesting jurisdictional issues. Gary is a former co-chair of the American Bar Association (ABA) Litigation Section Product Liability Young Lawyers’ Subcommittee.

Professional Liability
Gary has represented corporations in legal malpractice claims wherein attorneys of foreign jurisdiction mishandled client interests and breached their attorney-client and fiduciary duties.
