Gerard Di Popolo defends various personal injury cases, mainly transportation and automobile related. Matters have included premises liability, auto liability, negligent hiring/supervision, negligent security, wrongful death, and intentional torts such as assault, battery and infliction of emotional distress. 

Gerard has litigated extensively in federal and state court forums and focused much of his practice on analyzing the case law and statutes regarding removal of actions to federal court. In addition, he has defended some Fortune 500 companies as well as a number of companies in the retail and food and hospitality industries. 

Prior to joining Wilson Elser, Gerard was employed at a defense firm based predominately in South Florida, where he handled mainly premises liability and automobile/ transportation collision cases. Gerard also assisted with cases involving medical malpractice and product liability as well as issues regarding tenders and demands for indemnification which often led to third-party practice.

Representative Matters

Obtained dismissal with prejudice of actions filed under Florida Statute 768.0755 alleging that a non-property owner/ operator can be held liable under the statute.
