Gregory Hagen is an experienced trial attorney with more than 30 years in the profession and a diverse trial practice. Greg has represented clients in professional liability, business litigation, construction, products, complex civil litigation and general liability matters. In addition, he has represented a variety of insurance carriers, sureties and construction trades, including both commercial and residential general contractors, subcontractors and design professionals in binding commercial arbitrations and jury trials. His complex litigation practice includes partnership disputes, bad faith actions, toxic tort claims and unfair business practice claims. Greg has tried numerous cases to successful conclusion by way of jury verdict, decision by bench trial or binding arbitration award.

Before arriving at Wilson Elser, Greg had a smaller practice catering to a variety of business clients, not only handling matters already in litigation but also advising clients on strategies for addressing upcoming projects, contract issues and conflicts when they initially surface. Greg brings this broader perspective to Wilson Elser, providing litigation avoidance strategies, offering ideas for early resolution and seeking cost-effective approaches to the handling of complex litigation issues.

Areas of Focus

Construction
Greg has handled binding arbitrations and trials in the construction arena. These have included matters related to large homes built on speculation, multi-family tract home projects, condominium projects and commercial projects. In his practice he has addressed matters related to mechanics’ liens and payment disputes. Also, Greg has been the lead attorney on dozens of large multi-family cases where he has represented the developer, the general contractor or one of the major subcontractors. Greg has represented developers, general contractors, subcontractors, suppliers, product manufacturers, architects and engineers. Among the clients that he represents are development companies, construction firms, builders, manufacturers and specialty trades.

Professional Liability
Greg has an active practice representing clients in professional liability matters. He has represented numerous attorneys, real estate professionals (agents and escrow officers), insurance agents and brokers, and design professionals. He has tried numerous cases to successful conclusion by way of jury verdict, decision by bench trial or binding arbitration award. He recently received a defense verdict on behalf of a mechanical design professional (in addition to the engineer’s unpaid fees) in a two-week jury trial in San Diego.

Lawyers' Liability
With more than 20 years of experience, Greg has developed a diverse trial practice with an emphasis on representing attorneys in professional liability matters. He currently has an active portfolio of legal liability defense matters and in the past few years has successfully defended attorneys where the underlying issues involved family law, tax, transactional, litigation, and estate planning matters. He has tried numerous cases to successful conclusion by way of jury verdict, decision by bench trial or binding arbitration award.

Representative Matters

Successfully represented a major building component product manufacturer in a number of high-exposure construction cases. In that litigation, Greg was able to highlight the installation problems and provide a detailed analysis of the areas in which installation guidelines were not followed, which in turn provided a basis for favorable settlements.

Obtained a multimillion-dollar jury verdict in a case where he represented a minority partner in a business partnership dispute involving various real estate investments. Meticulous preparation and an exhaustive review of financial documentation provided the basis for that result. Greg has also obtained favorable results, procedurally, by way of summary judgment.
