Jeremy T. Merkel Associate




Jeremy Merkel focuses his practice in the areas of cyber security and information governance in the context of the significant challenges presented by the management of data across the information life cycle. As a Certified Information Privacy Professional, he is current on the latest trends in the industry and uses this knowledge to counsel clients on addressing regulatory requirements, privacy laws and litigation obligations. In this capacity, he has counseled numerous clients through data breach incidents, including medical practices, financial institutions and professional services firms, and e-commerce companies.

Jeremy brings both insight and experience to clients facing critical data-related compliance challenges and business risks. He is experienced such topics as section 5 of the FTC Act, the Health Insurance Portability and Accountability Act (HIPAA), the Children's Online Privacy Protection Act (COPPA), the CAN-SPAM Act and state data breach notification laws. He also has a robust global assessment and investigation practice, regularly counseling clients on global cross-border data transfers and advising on complex transactional matters involving the use, disclosure and protection of data.

While in law school, Jeremy gained considerable experience with technology and the law through positions at Facebook, the Federal Trade Commission and Harvard's Berkman Klein Center for Internet & Society. He also served as a legal intern on the executive leadership team in the Office of the Attorney General of New Jersey. Prior to joining Wilson Elser, Jeremy was an associate at a boutique civil litigation firm in New York City.
