Jimmy S. Ly Of Counsel




Jimmy Ly is a seasoned litigator with experience in complex civil matters involving a wide range of issues, including personal injury, business litigation, construction defect, products liability, toxic torts and professional liability. He is well versed in all aspects of civil ligation, arbitration and appeals. In addition to practice in California, Jimmy has been admitted pro hac vice in state courts in Nevada and Colorado. 

Jimmy’s experience also includes investigating, adjusting and resolving high-exposure claims as a licensed insurance adjuster while working in the Complex Casualty Claims Group of AIG. In addition to receiving exemplary performance evaluations by senior managers, he was appointed to the AIG North West Leadership Council. 

Jimmy uses his extensive experience prosecuting and defending lawsuits, and his experience as an insurance adjuster, to obtain efficient resolution of claims through the application of proactive and targeted litigation strategies and techniques, in close coordination with consultants, clients and insurers. Jimmy’s focus on early evaluation of key issues of liability and damages maximizes early resolution opportunities, and enhances formulation of effective defense strategies. 

In addition to his civil litigation and appellate practice, Jimmy is an associate professor in the Paralegal Studies Certificate Program at California State University, East Bay, where he teaches courses in civil litigation, the rules of civil procedure and evidence and professional ethics. He frequently authors and presents Minimum Continuing Legal Education courses relating to new developments in civil litigation and discovery, evidence collection and best practices, and professional ethics.

Representative highlights of Jimmy’s experience include plaintiff-side representation of homeowner associations in large construction defect actions against developers, builders, contractors, architects, engineers and manufacturers. Additionally, he represented residential housing developers and contractors in defense of construction defect actions involving compliance with the functionality standards of California’s Right to Repair Act. Jimmy’s construction defect experience encompasses representation of construction project managers against claims of professional liability in the management of construction projects. He specializes in complex and high-exposure construction defect actions, and has handled cases in California, Nevada and Colorado.

Product Liability
Jimmy has represented major retailers and manufacturers for products liability claims, including various consumer products such as space heaters, scented tea light warmers, automotive infant safety seats and decorative home furnishings.

Professional Liability
In the field of professional liability, Jimmy has represented clients in diverse industries, such as attorneys and legal professionals, real estate agents and brokers, construction project managers, pest control professionals and home inspectors, in matters involving breach of fiduciary duties and professional negligence.

Personal Injury
Jimmy possesses extensive experience in the field personal injury, including related claims for wrongful death. The representative industries where he has handled personal injury or wrongful death cases include construction, transportation, retail and commercial leasing, and government services. 

Business Litigation
Representative of his business litigation experience, Jimmy has represented individuals and businesses in matters involving a wide range of claims, including breach of contract, unfair competition, fraud and misrepresentation, trademark and trade dress infringement, and misappropriation of trade secrets.

Toxic Torts
Jimmy’s experience in the field of toxic torts includes defense of manufacturers, distributors, contractors and retailers of products alleged to contain toxic ingredients or components.

Representative Matters

Jimmy is well versed in appellate matters, and representative achievements include a reversal by the Ninth Circuit on an abuse of discretion standard of a Federal District Court’s dismissal with prejudice sanction, and a published decision from the California Court of Appeal related to set-offs of pre-trial settlements.
