Joshua R. Zimmerman Associate




Josh Zimmerman is a seasoned litigator who advises clients in the areas of complex commercial litigation, tort and general casualty, product liability, professional liability, toxic tort, transportation litigation, e-discovery and real estate litigation. 

Josh has served as lead attorney on hundreds of cases in federal and state courts in Arizona and New Mexico. Prior to joining Wilson Elser, Josh worked at top-ranking national firms handling complex litigation, product liability, premises liability, real estate litigation and tort defense. He has extensive experience in complex motion practice including drafting and oral argument of dispositive and discovery motions. 

Josh has conducted direct examination and cross examination of parties, percipient witnesses, expert witnesses and corporate representatives, and he has managed the discovery and e-discovery processes for clients in federal and state courts in Arizona and New Mexico. Josh has researched and drafted appellate briefs for the Ninth Circuit Court of Appeals and he has extensive experience advising clients in arbitration and mediation proceedings.

Representative Matters

Drafted and argued a successful dispositive motion in a construction defect case on behalf of an engineering client that resulted in the complete dismissal of a third-party complaint seeking more than $220 million in damages.

Lead attorney on three real estate trials that all resulted in complete verdicts in our clients’ favor.

Led the identification, preservation, collection, processing, review and production of more than one million pages of electronically stored records in a civil rights class action case involving a class of 18,000 minors in state foster care.

Lead counsel on an ultimately successful pro bono habeas corpus case that involved numerous rounds of briefing before the United States Court of Appeals for the Ninth Circuit.
