Kathleen H. Warin Partner




Kathleen Warin is the Regional Managing Partner for the firm's Washington, DC office. She concentrates her legal practice on complex civil litigation, including product liability, professional liability and commercial liability cases. Her professional liability work includes the defense of medical and legal negligence cases as well as other professional negligence. Kathleen also is experienced in handling high-profile product liability cases in state and federal courts nationwide, including consolidated and multidistrict litigation. 

In addition, Kathleen has defended class action cases in federal and state court and complex commercial tort cases. She has successfully represented clients at the appellate level in federal and state court. She also has experience in matters involving securities, architecture/construction and bankruptcy. Kathleen has defended multiple cases in civil jury trials and has extensive experience in preparing and arguing motions in federal and state court.

While in law school, Kathleen clerked for judges in a state court and federal appellate court, experiences that helped her achieve the significant insight she applies to her legal practice.

Areas of Focus

Medical Device / Product Liability
Kathleen is a co-chair of the firm's Life Sciences practice. She has served as national coordinating counsel in a series of medical device cases across the country. Her experience includes managing the national defense for such cases in multidistrict litigation, consolidated litigation and individual cases in multiple jurisdictions. In addition, Kathleen has handled a range of product liability matters.

Legal Malpractice
Kathleen’s defense of an attorney begins with an immediate and comprehensive assessment of both the underlying matter and the malpractice claim, with a focus on early dismissal through pre-answer dispositive motions. She has handled legal malpractice claims such as complex matters involving real estate and commercial transactions; securities and immigration; and fraud schemes, including real estate “flipping” and “equity stripping” cases. Kathleen also has handled claims under the Racketeer Influenced and Corrupt Organizations Act (RICO) and failures to comply with the Real Estate Settlement Procedures Act (RESPA), the Maryland Protection of Homeowners in Foreclosure Act (PHIFA) and local consumer protection statutes, among others.

Medical Malpractice
Kathleen has defended health care providers in jury trials, specializing in the fields of obstetrics, gynecology, orthopedics, gastroenterology, anesthesia, internal medicine, cosmetic surgery, pediatrics, psychiatry and surgery. She also has defended paramedics and nurses in complex medical negligence cases. In addition, Kathleen has handled cases brought under local consumer protection statutes against health care providers. She has coupled her knowledge with the firm’s strength in insurance defense to attract a growing clientele.

Commercial Liability
In her commercial liability practice, Kathleen has worked on numerous matters encompassing varied specialties, including class action cases. Kathleen successfully defended a class action case alleging misappropriation of federal benefits as well as class action matters under the RICO Act and the Defense Base Act (DBA) as well as other commercial torts.

Kathleen has written appellate briefs for cases for state and federal appellate courts. She has argued before the Maryland Court of Special Appeals and D.C. Court of Appeals and successfully petitioned the Maryland Court of Appeals for certiorari in multiple cases.

Representative Matters

Currently serving as coordinating counsel for national litigation involving a medical device.The team has successfully opposed a petition before the Judicial Panel for Multi-District Litigation to consolidate the federal court cases into multidistrict litigation.

Obtained affirmance on appeal of an award of summary judgment after a full appellate briefing by the D.C. Court of Appeals in a professional negligence case originally brought against a national veterans' service organization.

Obtained a defense verdict in a jury trial in a premises liability case involving allegations regarding the safety of Washington Design Center elevators.

Successfully petitioned the Maryland Court of Appeals for certiorari in a case regarding the validity of a plaintiff’s expert opinion contained in a Certificate of Merit that was later disavowed in deposition.

Successfully petitioned the Maryland Court of Appeals for certiorari regarding the sufficiency of a jury demand in a civil case, which the Court of Appeals decided in our favor.
