Kathleen Warin is the regional managing partner for the firm's Washington, DC office. She concentrates her legal practice on complex civil litigation, focusing on the defense of life sciences companies in product liability suits. Kathleen is experienced in handling high-profile product liability cases in state and federal courts nationwide, including consolidated and multidistrict litigation. Kathleen also is co-chair of the firm’s Product Liability, Prevention & Government Compliance Practice and co-chair of the firm’s Life Sciences Practice.

Kathleen also has extensive experience in matters involving professional liability on behalf of physicians, health care entities and attorneys. She has defended class action cases in federal and state court in complex commercial litigation. Kathleen has represented clients successfully at the appellate level in multiple federal and state courts. She has defended cases in civil jury trials and has extensive motions practice experience in federal and state court in a variety of jurisdictions.

Areas of Focus

Pharmaceutical & Medical Device
Kathleen is a co-chair of the firm's Life Sciences Practice. She has served as national coordinating counsel on behalf of medical device companies in cases across the country. Her experience includes managing the defense for pharmaceutical and medical device cases in MDLs, consolidated litigation and individual cases in state and federal jurisdictions nationally. Kathleen also has served as national monitoring counsel for excess insurers, including international insurers, on life sciences litigation including pharmaceutical and medical device cases pending in the United States.

Product Liability
Kathleen is a co-chair of the firm’s national Product Liability, Prevention & Government Compliance Practice. She has represented U.S. and international manufacturers and distributors in product liability suits in state and federal courts across the country.

Professional Liability
Kathleen has defended health care providers in jury trials, specializing in the fields of obstetrics, gynecology, orthopedics, gastroenterology, anesthesia, internal medicine, nephrology, emergency medicine, cosmetic surgery, pediatrics, psychiatry and surgery. She also has defended paramedics and nurses in complex medical negligence cases. In addition, Kathleen has handled cases brought under local consumer protection statutes against health care providers. She also has defended attorneys in professional negligence cases.

Commercial Liability
Kathleen’s commercial liability practice includes representation of entities specializing in health care, securities broker-dealer compliance and product manufacturing. Kathleen successfully has defended class actions alleging misappropriation of federal benefits and claims arising under federal statutes such as RICO and the Defense Base Act as well as other commercial tort claims.

Appellate
Kathleen has successfully briefed and argued cases in state and federal appellate courts in numerous jurisdictions.

Representative Matters

Currently serving as coordinating counsel for national litigation involving a medical device.The team has successfully opposed a petition before the Judicial Panel for Multi-District Litigation to consolidate the federal court cases into multidistrict litigation.

Obtained affirmance on appeal of an award of summary judgment after a full appellate briefing by the D.C. Court of Appeals in a professional negligence case originally brought against a national veterans' service organization.

Obtained a defense verdict in a jury trial in a premises liability case involving allegations regarding the safety of Washington Design Center elevators.

Successfully petitioned the Maryland Court of Appeals for certiorari in a case regarding the validity of a plaintiff’s expert opinion contained in a Certificate of Merit that was later disavowed in deposition.

Successfully petitioned the Maryland Court of Appeals for certiorari regarding the sufficiency of a jury demand in a civil case, which the Court of Appeals decided in our favor.
