Kevin Dossett is a first-chair trial attorney representing key players and industry leaders in high-risk litigation. He has substantial experience in the areas of maritime personal injury and wrongful death, collision and limitation of liability, property damage, contractual defense and indemnity, trucking and transportation, and inland marine claims. With an advanced degree in admiralty law and operational experience in the marine transportation and drilling service sectors of the oil and gas industry, Kevin excels at communicating often complex issues to judges and juries in a practical and readily understandable manner. 

As an adjunct to his litigation practice, Kevin regularly counsels clients in the identification, preservation, collection, processing, review and analysis of electronically stored information (ESI) and computer forensics. He is experienced in responding to major marine casualties on an emergency basis, and as part of the firm’s Emergency Response Team becomes fully engaged, often within hours of the event, interviewing relevant parties and determining the facts of the incident, the potential need for specialized criminal attorney representation, hours or service issues, federal agency compliance concerns, safety violations and any other potential causation issues or concerns. He prides himself on providing results-oriented legal services in all phases of the defense of litigated matters, from initial investigation and discovery through dispositive motions, alternative dispute resolution and trial.  Representative clients include international and domestic drilling contractors, exploration and production companies, offshore construction and diving contractors, inland barge and towboat companies, and international and domestic underwriters. 

Prior to joining Wilson Elser, Kevin built a successful career of more than 20 years with prestigious firms in Houston, Texas.

Representative Matters

Secured dismissal of television production company client on personal jurisdiction grounds in Jones Act and general maritime law based suit arising out of plaintiff contracting necrotizing fasciitis during long-line fishing trip filmed by client for unscripted reality television episodes. 

Obtained take-nothing verdict in LHWCA 905(b) suit against leading offshore drilling contractor in case where trial court ordered death penalty sanction of striking pleadings twice, which orders were twice overruled on mandamus to the Houston Court of Appeals prior to trial. 

Successfully resolved negligence and implied warranty claims against licensed property broker for damage to perishable food cargo based on Federal Aviation Administrative Authorization Act preemption.  

Obtained favorable resolution of Jones Act and general maritime law claims of commercial diver seeking $2 million with diagnosis of latent decompression sickness (bends) and cognitive deficits after locating records from local “pill mill” medical clinics indicating preexisting symptomatology and likely opioid addiction. 

Successfully represented international offshore drilling contractor against wrongful death claim arising out of cardiac event experienced by contractor aboard rig to address well control event for operator caused by terrorist attack off the coast of Nigeria. 

Obtained summary judgment on behalf of bunker oil provider against vessel owner asserting breach of contract claim based on third-party beneficiary status following major marine pollution incident allegedly caused by excessive flow rate.  

Successfully resolved Jones Act and general maritime law−based suit arising out of allegations a vessel’s chief engineer contracted endocarditis following exposure to the vessel’s brown water system during dry-docking.  

Secured the voluntary dismissal of Jones Act and general maritime lawsuit against inland towing concern after taking contentious deposition of former deckhand plaintiff. 

Prepared, filed and argued limitation of liability pleadings for vessel owner following BP Macondo well explosion, resulting in concursus proceeding in Houston federal court prior to multidistrict transfer to New Orleans federal district court. 

Secured voluntary dismissal of $40 million claim against offshore drilling contractor by platform owner following rig loss of station during hurricane. 

Obtained defense verdict in Jones Act suit against leading dredging and marine construction client in Rio Grande Valley state district court. 

Obtained forum non conveniens dismissal of Jones Act and general maritime law claims of Mexican nationals against leading offshore drilling contractor. 

Obtained summary judgment under economic loss doctrine on negligence-based claims asserted against manufacturer of prefabricated billeting units damaged during ocean transit to United States Air Force bases in Qatar, Oman and Bahrain. 

Successfully represented harbor tug in rem and vessel owner in multiparty litigation arising out of the grounding of a bulk ore carrier across the Neches River at Port Arthur. 

Successfully defended Fortune 500 engine manufacturer against claims of downstream manufacturer and distributor seeking indemnification for customer claims of lost profits caused by allegedly defective commercial logging equipment.
