Michelle DeMaio has represented clients and companies regarding general liability issues, including construction defect, premises liability and motor vehicle from soft tissue to catastrophic injuries as a civil litigator for more than 15 years. She handles all aspects and stages of litigation up to and including trial.

Prior to becoming an attorney, Michelle was a claims adjuster for nearly 10 years, where she gained the insight needed to advance her clients’ interests, including early assessment and risk management. Michelle has presented on topics including subrogation, bodily injury evaluation and assessment, taking and defending depositions, automobile defects, and the California Insurance Guarantee Association.

Representative Matters

Obtained $2,500 jury verdict as sole counsel where, through experts, the Kaiser recommended rotator cuff surgery was determined not to be related to the subject car accident. Verdict was below defendant’s 998 resulting in plaintiff paying defendant’s expert costs and fees.

Tried a personal injury case as sole counsel where a jury agreed with defense’s position that plaintiff’s claim for an aggravation of her IBS was not causally related to the car accident.
