Philip DeNoia focuses his litigation practice on the defense of premises and security officer liability, construction accident liability, product liability, and Dram Shop claims brought in the five boroughs of New York City and in various counties throughout New York state. On behalf of hospitals, banks, restaurants, nightclubs and product manufacturers, Phil has been successful in obtaining numerous dismissals on summary judgment and also has negotiated many favorable settlements and discontinuances.

Phil recently defended a building owner in a construction worker accident claim under New York Labor Law in which he prevailed on summary judgment over the plaintiff and co-defendant general contractor, which were ordered to pay attorneys’ fees. In the premises security area, he has defended hospitals and nightclubs in litigation brought by patients and patrons alleging excessive force and assault and battery by in-house security guard personnel. Phil’s product liability practice concentrates on the defense of manufacturers of recreational equipment such as trampolines, bicycle parts & components, all-terrain golf carts and inflatable “bouncy houses.”

In keeping with his clients’ desire for efficient and cost-effective claims handling, Phil frequently utilizes non-binding mediation when appropriate to bring about a quicker resolution. His past experience as a plaintiff’s attorney further enables Phil to accurately assess claims as well as determine when cases are overvalued.

Since 2010, Phil has served as an appointee to the Town of Lewisboro, NY, Conservation Advisory Council, which drafts advisory opinions that the Town Planning Board relies upon in rendering its decisions regarding the environmental impact of proposed projects.
