Robert E. Scott Jr. Of Counsel




Robert Scott focuses his practice primarily on complex civil trial litigation. With more than 45 years of practice, he has experience litigating in all areas of product liability, drugs and medical devices, environmental/toxic torts, construction and insurance coverage in state and federal courts throughout the United States. Bob also has served as national counsel in insurance coverage and product liability litigation and has represented a number of companies in class action litigation. 

Bob has published articles and lectures nationwide on issues pertaining to drugs and medical devices, product liability, toxic tort/environmental law, trial skills and insurance coverage issues. Bob is the recipient of the 2018 John H. Mudd Lifetime Achievement Award from the Maryland Defense Counsel, and the 2016 DRI Louis B. Potter Lifetime Professional Service Award, which honors an individual who exemplifies the highest professionalism and service to the legal profession. He is AV® Preeminent™ rated by Martindale-Hubbell, the highest possible peer review rating for ethics and legal ability. 

Early in his career, Bob served as a law clerk for Chief Judge Edward S. Northrop, United States District Court for the District of Maryland.

Areas of Focus

Drug & Medical Device Location
Bob serves domestic and foreign manufacturers of drugs and medical devices in connection with regulatory compliance, claims and litigation. He acts in various capacities defending suits against name-brand and generic drugs and approved or cleared medical devices. Wilson Elser’s national in-house infrastructure facilitates handling and defense of large, cross-jurisdictional mass tort litigation with dockets numbering in the hundreds. Bob taps the firm’s national network of more than 30 strategically located offices as an essential forum for developing and coordinating uniform mass tort defense strategies.

Product Liability
Bob has represented manufacturers and distributors of a wide variety of consumer products, including but not limited to cranes, forklifts, lasers and other equipment. He also defends and investigates claims and lawsuits against his clients in suits involving numerous products. Serving as national counsel in product liability litigation Bob has helped coordinate the defense of claims across the county and internationally. In this capacity, he works closely with his clients’ in-house legal departments and professional staff to develop comprehensive strategies to achieve favorable results.

Toxic Tort
In the area of toxic torts, Bob has experience handling a variety of environmental claims and has significant experience in the defense of various alleged toxins such as mold, lead paint, benzene, vinyl chloride and other chemicals. He also is highly skilled in the defense of latent injury cases, including those involving asbestos and talc. Bob has defended such actions in federal, state and appellate courts across the country.

Insurance Coverage
Bob represents insurers and reinsurers nationwide in high-exposure insurance and reinsurance coverage disputes in state and federal courts. In addition to litigating matters, he analyzes coverage issues, drafts coverage opinions, and prepares reservation of rights and disclaimer letters. Bob drafts policy language as well as insurance coverage settlement agreements and has helped to resolve coverage disputes between carriers through binding arbitration. Bob is experienced in interpreting a wide variety of policy forms for primary as well as excess insurers and has served as national or local counsel in coverage disputes.
