Robert F. Walker, CIPP/US, is a co-chair of the firm’s Cybersecurity & Data Privacy Practice. He dedicates his practice to helping clients respond to security incidents, comply with numerous data privacy and security requirements, and assert and defend against claims in state and federal litigation. Robert counsels companies, including management teams and boards of directors, in response to security incidents and data breach investigations involving malware, network intrusion, inadvertent disclosure and ransomware. With decades of experience as a litigator and an appreciation for the priorities of companies and business owners, Robert brings a unique perspective to data privacy and compliance issues.

Cybersecurity & Data Privacy
Robert is consulted and retained as immediate data breach counsel for clients who experience cybersecurity incidents. He leads a team of attorneys who provide 24/7 breach response services for companies in the United States and Canada, and advises and guides clients through the critical first steps of responding to breaches that may pose risks of operational disruption, sensitive data release and/or reputational consequences. He guides his clients through the entire incident response process, directing forensic investigations, consulting with federal and state agencies, developing post-incident response notification plans and responding to regulatory investigations. Robert is well versed in the compliance responsibilities imposed by GDPR, HIPAA, GLBA, state data breach notification laws, and related data privacy regulations and guidance.

Robert’s experience in cybersecurity breach response also enables him to counsel clients effectively on proactive data security practices, including designing pre-incident response and preparedness plans. 

Robert’s extensive experience litigating civil suits in state and federal courts has given him an appreciation for the distinctive priorities and pressures of owning or managing large and small companies. He has defended a variety of manufacturers in product liability and personal injury litigation through trial and appellate resolution. In addition, Robert has represented beneficiaries and fiduciaries in disputes involving alleged breaches of fiduciary duty, disputed accountings and will contests. He also has advised health care providers and individuals in matters involving the False Claims Act, including qui tam litigation, related to Medicare and Medicaid reimbursement issues.

Representative Matters

Represented the Mississippi Insurance Department in a contested $1.6 billion corporate restructuring of Mississippi's largest property and casualty insurer under Mississippi insurance holding company and change of control statutes. 

Represented regional pharmacy in state Medicaid litigation involving pharmacy discount programs and impact on usual-and-customary pricing. 

Represented manufacturers in state and federal court in Mississippi tobacco product liability litigation involving both mass actions and individual claims, coordinating joint defense discovery and motion practice. 

Successfully represented major casino in state tax appeal of denial of refund claim that was in excess of $2 million and was based on use of gaming tax credits. 

Represented beneficiaries in multiple will contests challenged on the grounds of undue influence and lack of capacity, as well as the related disposition of the decedents' multimillion-dollar estates. 

Represented automobile manufacturer in product liability lawsuits alleging defects in various components and systems, including fuel systems, restraint systems and electrical systems. 

Represented a national trucking company in high-exposure cargo claims and cases alleging negligent driving and training. 

Defended manufacturer of pelvic mesh devices in multiple suits in federal court and served on the expert witness team. 

Successfully defended automobile manufacturer at trial in multiple wrongful death products liability trials relating to alleged defects in the vehicle's fuel system. 

Successfully defended automobile manufacturer in dozens of lawsuits related the vehicle’s speed control deactivation switch. 

Obtained summary judgment for automobile manufacturer in a products liability case involving an alleged engine compartment fire after successfully excluding an expert witness. 

Successfully defended an automobile manufacturer at trial in a high-exposure property damage case related to a passenger compartment fire allegedly caused by a defective wiring harness.
