Scott Tropio is a highly experienced trial lawyer and litigator whose practice centers on product liability; trucking, premises and construction accident liability; and commercial litigation. He defends clients in civil litigation in state and federal courts in California and throughout the western United States. Scott has tried more than 300 cases, taking more than 50 to jury verdicts. In addition, he has tried and arbitrated hundreds of non-jury matters.

Relying on a team-based approach comprising attorneys with impeccable credentials and complementary skills, Scott has handled cases involving a variety of damages and injuries, including neurological, psychological, brain injury and death. He also has acted as national coordinating counsel for major corporations on a number of projects. For the past 10 years, he has acted as Western States Regional Counsel for toxic tort and personal injury matters for one of the largest oil refining companies in the world. In addition, Scott has been supervising litigation in the states of Washington, Oregon, Nevada, Arizona and New Mexico, and is currently developing new petroleum clients across the western states.

Respected for his confidence and work ethic, Scott uses his vast experience to home in on the essential aspects of a case. He is known for his ability to form strong client relationships and build credible industry knowledge. Scott has been asked to lead seminars by DRI and HarrisMartin and is a frequent guest lecturer for corporations as part of their training programs and for special events.

Areas of Focus

Products, Petrochemicals, Construction & Premises Matters
Scott has handled dozens of personal injury, insurance coverage and property damage cases and defended products, premises, construction, motor vehicle, wrongful termination, maritime, oil field, pipeline and refinery cases. He has defended materials suppliers, automotive, consumer, energy and industrial product manufacturers and distributors in all types of occupational injury, toxic tort, personal injury, Proposition 65 and property damage litigation. Scott routinely defends chemical exposure cases in addition to ground-water and soil contamination matters.

Scott’s trial practice includes product liability covering toxic torts, chemicals, groundwater and forklifts; construction defect; oil & gas refining, terminal and pipeline transmission; maritime vessels; above- and below-ground storage tank releases; refinery turnaround exposures and explosions; other fire and product explosions, retail and gasoline station premises and security matters; ships, barges and other vessels; storage tanks and process equipment; toxic torts and major complex multiparty actions − all with an emphasis on the California and western states energy, petrochemical and maritime industries.

Rapid Response Team
Scott is an active member of the firm’s Rapid Response Team with access to Wilson Elser “go teams” comprising those attorneys and support personnel who are best equipped to handle emergencies in the field. Team members become fully engaged, often within hours of the event and, when circumstances dictate, are on-site gathering the information and witness insights that can help clients manage investigatory demands and fortify potential future litigation defenses. Scott interviews relevant parties and determines the facts, the potential need for specialized criminal attorney representation, hours or service issues, federal agency compliance concerns, safety violations and other causation issues or concerns.

Commercial Litigation
Often national in scope, Scott handles business litigation for a construction supply company, a specialty insurance group and several major oil & gas concerns, in addition to a major retailer. He also represents another of the largest oil refining companies in its southern California matters with growth potential for most of the western states, from Texas to Washington. Scott handles breach of contract cases for a construction materials provider and an oil refining company. He also represents major fashion retailers and their flagship brands from lingerie to perfume to candles, in premises and products cases. These cases involve the gamut of premises complaints (assault, false arrest, false imprisonment) and product matters (body discoloration, exposure and burns).

Insurance Lines & Coverage
Scott has had a long relationship with a mid-western insurance mutual and its multiple affiliates, which provide commercial, commercial umbrella, employment, automotive, property, cyber liability and recreational vehicle lines. Matters run the gamut of insurable events and include coverage opinions. Scott is looking to expand this practice, with active opportunities in the Midwest and from Minnesota to Florida to Pennsylvania.

Representative Matters

Defended a products liability claim brought by a woman who was rendered a paraplegic after a catastrophic failure resulting from an allegedly defective attachment on a riding vehicle. The plaintiff’s spinal cord was not completely severed. While her paraplegia was complete, she did retain just enough of the spinal cord to remain in excruciating pain for the rest of her life. The jury awarded a defense verdict after a three-week trial.

A jury in three-week trial awarded a defense verdict in an automotive repair case brought by the parents of a minor decedent.

In another trial, an admitted liability case, he tried a rear-end hit-and-run collision in which the driver of an RV, traveling about 50 mph, struck a California Highway Patrol vehicle that was stopped on the side of the freeway. The plaintiff, an on-duty officer, was sitting inside the car at the time. The jury awarded the officer the amount of the pre-trial offer.
