Stephen B. Smith Of Counsel




Stephen Smith has practiced Insurance Law for more than 30 years, providing insurers and companies with coverage analysis and defense litigation. A portion of his practice involves assisting clients in navigating the claim process, which includes preparing reservation of rights statements and other correspondence generated during the claim process, as well as litigating coverage issues. Another significant part of his practice involves litigating liability and transportation cases, including non-subscriber cases. Stephen also has reviewed coverage issues in general liability, D&O, construction and pollution coverages, in addition to property coverages.  

Stephen’s diverse clients include insurers as well as corporations and carriers that he assists in a wide variety of issues from simple property and casualty claims to more complex coverage and litigation matters. He has tried numerous cases in district court and other courts, and has assisted insurance clients in coverage, regulatory and claims matters. Stephen teaches courses for insurance professionals and has taught continuing legal education seminars for attorneys.

Representative Matters

Represented excess insurer in coverage dispute arising out of a $200 million verdict.

Filed writ of mandamus to prevent coverage adjuster from being deposed in underlying litigation.

Obtained defense verdict in brain injury case where the plaintiffs’ lowest demand was $1.5 million.

Obtained summary judgment in coverage pollution case.

Successfully tried an accounting malpractice case to verdict.
