Tawana Johnson is a member of the firm’s Cybersecurity & Data Privacy Practice, focusing on helping clients respond to cybersecurity incidents, comply with state and federal data privacy requirements, and respond to state and federal regulatory investigations.

Tawana also defends insureds and companies in all phases of litigation, including commercial disputes, contract litigation, intellectual property, data breach, medical malpractice, premises liability, products liability, toxic tort, personal injury claims, professional liability, construction litigation, transportation/ trucking, employment litigation and appeals. She has extensive experience handling all aspects of litigation in state and federal courts, appellate litigation, arbitration and alternative dispute resolution.

Areas of Focus

Cybersecurity & Data Privacy
Tawana consults as data breach counsel for clients who have experienced cybersecurity incidents, including business email compromise, wire fraud and ransomware attacks. She is part of a team that is on call 24/7 to assist clients with breach response services throughout the United States and Canada. Tawana advises clients during breach response to minimize operational disruption, containment and restoration following an attack, and forensic investigation. She guides clients through post-incident notification and regulatory reporting requirements, and assists clients with responding to state and federal regulatory investigations. Tawana is experienced in compliance with state data breach notification laws, GDPR, HIPAA, FERPA and GLBA requirements.

Pharmaceuticals & Medical Devices
Tawana worked for a major pharmaceutical company for more than five years. She has extensive experience in regulatory matters, including research and development, clinical operations, human clinical trials, drug safety, adverse event reporting, FDA audits, post-marketing surveillance and product recalls. Tawana has worked with pharmaceutical drugs and medical devices. Her extensive scientific and technical background is invaluable to clients, and enables her to communicate complex scientific issues to clients, judges and juries. Tawana’s scientific and technical background also has helped her clients in complex products liability matters. She has successfully defended manufacturers in a broad range of products liability cases, from complex machinery to smaller component parts, medical devices and prescription drugs.

Employment Law
Tawana represents businesses in all aspects of employment law, including tort and contract claims, defense of EEOC charges, whistleblower claims, employment discrimination and sexual harassment litigation, employee benefits litigation, wage-and-hour issues (including collective action litigation), labor matters, ADA claims, violation of non-compete agreements and retaliation claims. She also has counseled clients during downsizing and in drafting employment agreements.

Represented architects, engineers and construction firms in professional liability and intellectual property disputes.

Represented creditor clients in obtaining and collecting on judgments in matters involving contracts, suits on promissory notes and guarantees, and other creditors’ rights matters.
