Timothy J. McKay Of Counsel




Tim McKay is an experienced trial attorney with strong ties to the Chicago legal community. During his nearly 40-year career, Tim has built a significant practice in Illinois and nationwide representing nationally known hotel, casino, restaurant, riverboat and retail industries in personal injury claims. Tim also has a background in medical malpractice and defense litigation, and his familiarity with the Chicago medical community facilitates the selection of damages experts in the various medical field specialties.

Tim has defended some of the country’s largest hotel, restaurant, gaming and retail companies for claims ranging from wrongful death, dram shop liability, foodborne illnesses, slip-and-fall incidents, and sexual assaults. His general liability practice extends to the defense of clients in vehicular and trucking accident claims as well as in construction accident and fire and property loss litigation. On behalf of his clients, Tim works closely with many insurers, third-party administrators, risk managers and general counsel to cost-effectively manage litigation and achieve successful outcomes.

Throughout his career, Tim has tried several hundred bench trials and more than 20 jury trials to verdict. He also has written many appellate briefs and argued both civil and criminal appeals before the Illinois Appellate Court. Tim served as an Assistant State’s Attorney in Cook County, Illinois, from 1979 to 1984, in the Appellate Division and the Felony Trial Division, where he tried high-profile felony and murder cases, including two death penalty cases. Tim also is well known to the various mediation entities in Chicago and is a frequent participant in alternative dispute resolutions. He has participated in more than 100 successful mediation proceedings on behalf of his clients in Illinois and nationally.

Professional/community activities: Tim was previously a partner/shareholder in the law firm of Johnson & Bell, Ltd., from 1984 to 1998, where he served as a member of the compensation committee and managed his own practice group. Tim left Johnson & Bell to become a managing partner of McBreen, Kopko, McKay & Nora, where he represented his clients in Illinois and opened a satellite office in Las Vegas to represent various casino gaming companies until 2005. Tim then founded and became managing partner of McKay, Nora, Tanzillo, Daddino & Kott, LLP, from 2005 to 2010, before joining the nationally recognized law firm Wilson Elser to better serve his clients nationwide.

In addition to formerly managing his own law firm, Tim has presented to personnel at major hotel and casino companies on premises liability, dram shop defense litigation, claim handling, security training, risk management and other topics. Tim is a former member of the Zoning Board of Appeals for the Village of Glen Ellyn, Illinois, and a former Secretary and Member of the Board of Governors at Butler National Golf Club in Oak Brook, Illinois. Tim currently serves on the Boards of Directors of two Florida-based and A-minus rated property and casualty insurance companies. He also is involved in charitable fundraising efforts for various health, church and philanthropic organizations in the Chicagoland area.
