Tracy A. Kinneary Associate




Tracy Kinneary is a civil litigator who focuses her practice on general liability matters and the defense of complex litigation. A significant portion of Tracy’s practice concentrates on defending against high-exposure construction claims involving Labor Law matters, contractual indemnification issues and insurance coverage litigation. Tracy has argued multifaceted Labor Law matters before the New York Supreme Court and is familiar with the intricacies of claims brought in connection with construction site accidents and all other potential litigation arising out of construction projects.

Tracy also handles a wide variety of transportation, product and premises liability matters involving personal injury and wrongful death claims.

Throughout her career Tracy has successfully defended property owners, national construction entities, general contractors, design professionals, subcontractors, trucking companies, municipalities, restaurants, nightclubs and hotels in general liability claims. She handles matters for clients from inception through resolution by dispositive motion, settlement, or mediation/arbitration, actively litigating cases in New York state and federal courts. Tracy brings a detail-oriented approach to the management of cases and provides her clients with a thorough analysis of all potential issues while identifying and seizing upon opportunities for early resolution.

Prior to joining Wilson Elser, Tracy was as an associate at a mid-size civil litigation firm where she concentrated her practice in a wide array of general litigation matters, specializing in the retail defense of Fortune 500 companies and insurance carriers.

During law school Tracy was granted an internship at the United States Attorney’s Office, Eastern District of New York and was selected as a member of the Criminal Justice Clinic where she represented indigent clients charged with misdemeanors in Nassau County District Court.
