Wayne I. Rabinowitz Senior Counsel




Wayne Rabinowitz is a results-oriented litigator driven by a desire to successfully defend physicians and hospitals in medical malpractice and related cases. Since joining Wilson Elser in 1982, Wayne’s primary professional activity and interest has been focused on medical malpractice litigation in both the public and private sectors. He started his practice in New York City and was one of five partners who launched the firm’s office in White Plains, now home to more than 150 attorneys.

On behalf of hospitals and their physicians, as well as physician assistants, nurses, nurse practitioners, optometrists and other allied health professionals, Wayne has defended malpractice claims arising from the full range of medical, surgical and emergency room services and involving virtually every discipline within the health care field. In addition to medical malpractice cases, he has experience representing hospitals and other clients in employment liability and civil rights, product liability, and motor vehicle liability litigation. Wayne has defended municipalities and municipal employees – including county departments of social services – for decades and is highly familiar with the sensitivities associated with such cases.

Wayne has tried cases in every county in the New York City metropolitan area and has taken verdicts in most all of them. He also has taken verdicts in the U.S. District Courts for the Eastern, Southern, and Northern Districts of New York. In addition to taking numerous cases to verdict, Wayne has achieved many advantageous settlements on behalf of clients before and during trial, has participated in extensive pre-trial discovery, and has developed a variety of successful defense tactics and strategies.

After he was admitted to the New York State Bar, Wayne spent six years working in the in-house counsel office of a major insurance company, where he represented defendants in motor vehicle, general, product, construction and municipal liability cases.
