William Enger has more than 20 years’ experience in business, general liability, product liability, aviation and insurance coverage litigation, including first-chair jury trial experience. Bill’s practice emphasizes representation of foreign and transportation-related companies in international disputes, and he draws on his teaching experience in international law to give his clients an advantage. He also has had success enforcing international commercial arbitration agreements to the advantage of foreign clients.

Areas of Focus

Asia Practice
Bill is lead counsel on the West Coast for collections on commercial matters originating in China, with an emphasis on consumer electronics and photovoltaic equipment. Bill spent time in Asia as a youngster and is very much intrigued by the dynamic changes and growth in the region.

Marine / Aviation
Bill is experienced in business, international, maritime, general liability and insurance coverage litigation, including first-chair jury trial experience. Bill has successfully represented recreational boat and passenger vessel operators during trial of serious personal injury claims. He currently serves as trial counsel for a major marine operator in casualty litigation, including personal injury, property loss and environmental claims. Bill represents excess liability insurers regarding high-exposure cases.

Bill also handles major litigation and provides insurance counseling for aviation clients faced with bodily injury and property damage losses during air transit operations.

Toxic Tort / Environmental
Among his environmental experience, Bill has represented the London Market insurers in complex environmental coverage litigation, including asbestos coverage involving products and non-products claims; the defense of an environmental consultant/industrial hygienist in complex toxic tort personal injury claims involving exposure to welding fumes; and the defense of an environmental consultant in a professional negligence claim involving the accidental uncapping of an abandoned oil well.

Bill advises domestic, London Market and other off-shore insurers and reinsurers on MTBE contamination, CERCLA claims and other high-exposure losses.

Construction
Bill has represented clients in a wide variety of construction accident lawsuits stemming from scaffold and crane accidents and other matters.

Insurance / Reinsurance
Bill represents excess liability insurers regarding high-exposure cases. He is highly experienced in the assessment and analysis of reinsurance coverage issues and requirements, whether for facultative reinsurance claims or in the larger context of reinsurance treaties.

Property / Casualty
Bill has broad experience with various types of property coverage disputes related to casualty and catastrophic events such as earthquakes, floods, fires, and wind and weather. These events involve all forms of real property, including commercial and high-value residential property as well as commercial equipment.

Representative Matters

Prevailed in dismissal of a case brought by a passenger who claimed to have developed a blood clot following his fall from a power scooter aboard a coach transporting him during the land portion of an Alaskan vacation package.

Bill is lead counsel on the West Coast for a state-owned Chinese insurance company for commercial matters.

Obtained voluntary dismissal for a Canadian firm in a commercial dispute alleging fraud in the sale of manufacturing equipment.

Represents numerous Chinese manufacturers and their subrogated export credit insurer in high-value commercial disputes with U.S. buyers.

Successfully enforced international commercial arbitration agreements for a Bermuda-based cruise ship company.

Successfully represented recreational boat and passenger vessel operators during trial of serious personal injury claims.

Currently serves as lead trial counsel for a major U.S.-flagged marine operator in casualty litigation (including personal injury, property loss and environmental claims) and represents excess liability insurers regarding an oil well blow-out and fire resulting in death and substantial property damage.
