William Fitzgerald zealously defends clients in a wide variety of tort litigation, including automobile and trucking liability, industrial accident, maritime, property damage and general negligence. From minor impact collisions to catastrophic losses, over his more than 15-year career, Will has successfully resolved hundreds of suits, always seeking the best resolution through settlement, summary judgment or trial. He is equally comfortable before a mediator, judge or jury in state and federal court. 

Will joined Wilson Elser from a mid-sized firm that provides legal representation along the entire gulf coast. He has first- and second-chair trial experience and has tried many jury and bench trials in state and federal courts. 

Will’s tenure in the U.S. Navy during Desert Shield and Desert Storm honed his sharp instincts and leadership skills, both of which serve his clients well in the courtroom. Those talents, in combination with his legal knowledge and quick wit, make Will a consistently formidable opponent who obtains positive outcomes on a continuing basis.

Obtained summary judgment for Underwriters in case arguing timely payment of appraisal award nullifies both contractual and extra-contractual liability; affirmed on appeal. (Blum’s Furniture Company, Inc. v. Certain Underwriters at Lloyd’s London, 459 F. App’x 366 (5th Cir. 2012)) 

Obtained denial of Plea to the Jurisdiction filed by the City of Pasadena, Texas, in case involving on-duty police officer in head-on collision with client; affirmed on appeal (City of Pasadena v. Belle, 297 S.W.3d 525 (Tex. App. − Houston [14th Dist.] 2009, no pet.))
