Peter Moore (Partner-McLean, VA) and Bryce Adams (Partner-Portland, OR) will present “Properly Evaluating and Handling Claims to Avoid Bad Faith” on October 16, 2025, as part of the Wilson Elser Forum Insurance Coverage Best Practices series. Effective evaluation and handling of claims, along with early identification of potential bad faith scenarios, can help prevent insureds from asserting bad faith claims in most situations – or render them meritless. Strategies include diligent investigation, efficient and timely claims handling, and appropriate and continuous assessment of the duty to defend and the duty to reasonably settle claims. Peter and Bryce will present a coherent overview of bad faith principles, demonstrate how differences across jurisdictions can affect potential bad faith claims, and provide best practices for avoiding bad faith claims and addressing them when they arise.
