Charles Simmons focuses his practice on construction defect litigation, principally in defense of subcontractors and including architects and engineers. Chuck’s familiarity with right-to-repair statutes, warranty programs and case law in various jurisdictions enables him to provide experienced counsel in managing liability resulting from construction defects. A natural adjunct to his work with construction matters, Chuck also is experienced with premises liability and general liability cases. Chuck advises clients of their right to repair alleged defects within statutory deadlines and anticipate the most likely litigation outcomes, thereby enabling them to make more informed decisions relative to proceeding to trial or negotiating a reduced settlement.
Chuck has handled numerous construction defect cases in northern and southern Nevada, frequently handling matters involving general contractors or on behalf of insurers that offer wrap-up coverage extending to all contractors on a construction site or a series of projects. From planning to design to construction to the efficacy of completed projects, Chuck analyzes complex construction defect claims under typical general liability and payment and performance bonds, as well as subcontractor default insurance and consolidated insurance programs. He has tried cases and succeeded on appeal in a case before the Nevada Supreme Court. Chuck was also instrumental in managing a very successful large-scale construction defect program with a major insurance company across several western states, including Nevada, California, Arizona and Colorado.
As managing partner of the Nevada office of a regional commercial litigation law firm for twelve years, Chuck handled and supervised hundreds of construction defect cases from inception to conclusion across the firm’s offices in several states. He was also responsible for training and mentoring new and experienced attorneys and presented training seminars to the entire firm in areas involving case analysis, negotiation and mediation techniques and communicating with clients and insurance carriers.
