This 15-minute episode analyzed the First Circuit Court of Appeals’ decision in Axis Insurance Company v. Barracuda Networks, Inc. in which the court held that a subrogating insurer (Axis) could not recover equitable indemnification or contractual damages from a vendor for a data breach involving protected health information (PHI). With subrogation in this context a hot issue in the insurance sector, the podcast already has drawn a large audience.
