B. Otis Felder (Partner-Los Angeles) will serve as a featured speaker at an upcoming NBI webinar on March 31, addressing the intersection of artificial intelligence and evidence law in federal litigation. Felder, who also serves as a professor at USC Gould School of Law, will cover critical topics including AI-related litigation risks under Rule 11 and Daubert, privilege and confidentiality concerns when clients use generative AI tools, and the authentication of AI-generated evidence under the Federal Rules of Evidence. The program will examine recent federal case law, where attorneys were sanctioned for submitting AI-fabricated case citations and another case where the court held that client communications with a public AI platform were not protected by attorney-client privilege. Felder, a member of Wilson Elser’s National Trial Team, will also guide attendees through witness examination techniques, expert testimony foundations, and best practices for law firm AI governance, including verification workflows and written policies to mitigate risks.
