Patrick Kearns (Partner-San Diego) presented to a full house at an MCLE presentation for the San Diego Defense Lawyers Association. The presentation, titled “A Detailed Look at Pebley v. Santa Clara,” addressed a recent California appellate decision that held an insured plaintiff can choose to forgo using his health insurance in favor of treating on a lien, and thus permitting a larger damages number to be introduced at trial. Patrick presented along with one of the appellate lawyers involved in the case, and discussed the impact of the decision on California defense litigation along with tips for handling the decision in discovery and trial.
