The panel will explore how plaintiffs have refined their playbook to put carriers and their insureds on their heels, focusing on the challenges posed by time-limited demands within policy limits and the strategic choices carriers face in deciding whether to “stay” and accept a potentially inflated demand or “hit on a soft 17” and risk a more significant adverse verdict. When improperly handled, these demands can drive a wedge between the carrier, defense counsel, and the insured, increasing exposure. Kim’s panel will examine each party’s role in responding to these demands and techniques for ensuring they are appropriately handled.
