Topics discussed include how foreign manufacturers can avoid risks of U.S. litigation, including thinking strategically about their direct contacts with the country for purposes of personal jurisdiction. Also addressed is the importance of foreign manufacturers who use subsidiaries using carefully constructed agreements to avoid agency, prevent indemnity issues, and control the flow of information and documentation into the U.S. to circumvent discovery issues should litigation ensue.
