Diana Estrada (Partner-Los Angeles, CA) will join a panel titled “Navigating the Shifting Landscape of Restrictive Covenants in the Insurance Industry” at the Seventh Annual Meeting of the Insurance Networks Alliance (INA) to be held January 22–24, 2024, in Fort Worth, Texas. Producer and employment contracts, network agreements and M&A transactions will all be impacted by the Federal Trade Commission’s (FTC’s) proposed ban on noncompete agreements. Various states are proposing legislation that would severely limit restrictions as well. Diana’s panel will discuss issues with the greatest impact for networks and agent members and provide guidance on how best to prepare for these changes. Topics include an overview of current enforceable federal and state laws; where legislation is heading in the near future; strategies for developing new contracts and restructuring existing contracts; M&A implications when assuming existing contracts; and when legal review of contracts should be considered.
