Jonathan Meer (Partner-New York, NY) and Richard Bortnick (Of Counsel-San Diego, CA) will join Dale Schulenberg, Coalition, and JP Wilson, Global Cyber Risk Advisors Corp., for a December 7, 2022, webinar, “Practical Implications of Travelers v. ICS for Cyber Insurance Brokers, Carriers and Policyholders: Emerging Trends and Predictions.” The panel will address the growing cyber insurance market and discuss how the underlying representations about multifactor authentication by the insured in the Travelers case impacted the insurer’s decision to seek rescission of the policy. In a further discussion about cybersecurity representations in general they will highlight the emphasis by insurers on having not only multifactor authentication but also endpoint protection, secure backups, third-party risk management, training and other up-to-date controls. Finally, the panel will briefly address where they believe insurance coverage litigation may be going, specifically cyber insurance policies and their coverages, including potential future rescission and declaratory judgment actions.
