Anjali Das (Partner-Chicago, IL) and Jana Farmer (Partner-White Plains, NY) will provide a national overview of U.S. consumer privacy and AI regulation and the practical impact on insurance. The session will survey state-level AI legislation such as Colorado’s AI Act, Utah’s AI Policy Act, and Texas’s Responsible AI Governance Act, alongside the growing patchwork of comprehensive state privacy laws. The presenters will unpack the California Privacy Protection Agency’s finalized regulations on automated decision-making technology; examine the Attorney Generals’ legal advisory on how consumer protection, civil rights, competition, and privacy laws apply to AI; and address CPPA’s clarification of when CCPA applies to insurance data and discuss emerging insurance-specific privacy reforms such as SB 354, the Insurance Consumer Privacy Protection Act of 2025.
