Heather Austin (Partner-Philadelphia, PA) will present “Don't Get Trapped: Hidden Pitfalls in Interpleaders” at the 2023 DRI Life, Health, Disability and ERISA Seminar to be held April 26–28, 2023, in New Orleans, Louisiana. The presentation will focus on the interpleader process, as authorized pursuant to Federal Rule of Civil Procedure 22 (Rule Interpleader) and 28 U.S.C. §1335 (statutory interpleader). Heather will describe the distinctions between the two sources of authority, as well as their shared features. She also will discuss the circumstances when interpleader is or is not appropriate and the fate that may befall a stakeholder who elects interpleader when there exists no colorable competing claim and, equally important, the risks assumed when a stakeholder fails to use the interpleader process.
