Daniel Tranen (Partner-Evansville, IL) will present “Missouri ‘Show Me’ State or Coverage Hellhole?” before an insurance client of the firm on July 12, 2021. Missouri is a very difficult place for insurance companies, from the duty to defend standard to the use of panel counsel. It is a dangerous place to reserve rights, and if a reservation of rights defense is rejected, an insurer should strongly consider waiving its coverage defenses unless they are very strong. Missouri has a statutory mechanism by which policyholders are urged to make deals with plaintiffs if the insurer fails to defend or fails to settlement cases within policy limits. Daniel will discuss the cottage industry that has grown within this environment in which insurers are routinely subject to threats that their liability limits may be breached if they do not accede to sometimes very unreasonable demands.
