Carl Pernicone (Partner-White Plains, NY) will examine the newest way insureds are approaching claims for climate change liability in a Wilson Elser Forum webinar, “Turning Up the Heat on Climate Change Claims: The New Long-Tail Injury Exposure,” available on November 4, 2021. Older commercial general liability polices often are triggered by events that occurred during the policy period regardless of when the event is discovered. They therefore never expire – and often prove especially valuable because of the absence of exclusionary language. Carl will advise of the key underlying cases to watch and why historic policies are attractive targets for policyholders, with an outline of their “playbook” for pursuing such coverage. To balance the equation, Carl will provide an insurer defense checklist for an effective defense against such claims.
