With the rise of US bad faith claims, Canadian insurers have become acutely aware of the adjusting risks. Wilson Elser as a key nationwide counsel for Intact was asked to present. Partners Paul White (Los Angeles, CA), Daniel Tranen (St. Louis, MO) and Brian Del Gatto (Phoenix, AZ) presented for two hours on “U.S. Bad Faith Claims” on December 6, 2023, before the adjusters at Intact Financial Corporation. Topics included a synopsis of bad faith, including failure to defend and failure to settle; the bad faith rules in key states; general strategies to avoid bad faith; the bad faith set-up – in which plaintiffs maneuver insurers into committing acts that can later be trotted out as bad faith – and strategies to avoid it; and how to evaluate /adjust claims once credible bad faith has been alleged. Well over 125 people attended the talk and many questions were addressed of particular interest to the adjusters.
