Edna Kersting (Partner-Chicago, IL) and Joshua Bachrach (Partner-Philadelphia, PA) will present a one-hour webinar titled “Relationship Troubles – Employers and Their Benefit Insurers” on September 29, 2022, to discuss the difficulties that can ensue when an employer or plan sponsor mishandles enrollment. Topics include the failure to obtain evidence of insurability when required, deducting premiums when there is no coverage in place for the individual or misrepresenting available benefits or coverage. Edna and Joshua will address recent case law regarding the division of responsibilities, the applicability of agency law, recourse for mistakes made, as well as waiver and estoppel issues under state and ERISA laws.
