Daniel Tranen (Partner-St. Louis, MO | Edwardsville, IL) will appear on a panel titled “If You're Explaining, You're Losing: Evaluating the Risk of Communicating a Science-Focused Defense to a Jury” at the CLM National Conference to be held April 2–4, 2024, in San Francisco, California. In many areas of product liability litigation, the best defense to raise to a jury at trial will likely be heavily invested with scientific theory and concepts. Accordingly, while the defense may be strong, it can fail if the jury does not understand it. Dan and the panel will discuss the common difficulties and methods used to communicate scientific concepts to a jury, which may impact the way insurers evaluate the risk of taking a science-heavy case to trial. Further, the discussion will touch on similar efforts in communicating the science with judges in Daubert motions, where judges are the gatekeepers for the validity of the scientific method that ultimately may be shared with a jury.
