Gerard Heubel (Partner-White Plains) and James Kachadoorian (Partner-White Plains) explored the impact the Patient Protection and Affordable Care Act (ACA) could have on awards for future medical costs in “Can the ACA Help to Reduce Jury Awards?” in the October 30, 2015, issue of   Westchester County Business Journal. Passed to make health care and health insurance more available and affordable to a greater number of people, the ACA also may have an unintended impact on personal injury litigation. “With the implementation of mandatory health care coverage for all,” Jerry and Jim say, “the justification for not reducing plaintiffs’ future medical costs by the amount covered by health insurance is without merit.”
