Adam R. Bialek (Partner-New York) and Kara Thorvaldsen (Partner-Boston) collaborated on a white paper, “COVID-19 Moves ADA Compliance for Websites to the Forefront,” with Lawrence Shaw and Nicholas Le Seelleur, executives of AAAtraq, a fully automated system providing digital supply chain management, compliance pathways and training services.

Online activity has increased significantly since the COVID-19 pandemic began, particularly as it relates to retail and gaming. E-commerce has exploded in multiple sectors, including home products/furnishings, garden essentials and electronics. The inability to fully engage with websites can inhibit the ability of persons with disabilities to participate in many aspects of society – especially given the constraints of the pandemic. The authors posit that well over 90% of websites are not ADA compliant, which leaves the operators open to legal action against them. The white paper describes how businesses need to understand that Web accessibility cannot be considered a one-off project or dealt with in isolation. It requires a consistent, systematic and monitored approach – indeed, it may require a change in company culture. In that respect, automation lends itself to greater efficiently and accountability.
