Buono (Associate-Las Vegas, NV) authored “Sandy Hook Settlement Impact on Mass Shooting Cases and Legal Strategies in Defending Gun Manufacturers and Premises Owners” for the May 3, 2022, edition of Westlaw Today. In the wake of the 2012 Sandy Hook mass shooting, the nine families who suffered a loss entered a $73 million settlement with the maker of the rifle used. Avoiding the Protection of Lawful Commerce in Arms Act, which largely protects firearms manufacturers from liability when crimes are committed by a third party, the families argued the manufacturer’s violent marketing violated the Connecticut Unfair Trade Practices Act. The payment came from four insurers representing the full amount of coverage available, and demonstrating that insurers need to assess liability as these tragedies become more frequent. Stratton, Karen and Taylor also discuss how premises such as stores, malls and restaurants need to understand the possibility of premises liability suits as foreseeability is becoming increasingly difficult to deny.
