John Cahill (Associate-White Plains), Jana Farmer (Partner-White Plains) and William Behr (Partner-New York) collaborated on “First DOJ NFT Insider Trading Charges Mark New Enforcement Era,” which appeared in the June 29, 2022, issue of Bloomberg Law. The authors report on the first indictment for an insider trading scheme involving non-fungible tokens (NFTs) and show how the Department of Justice and the NFT community worked together in this new space. Going forward, “[t]he DOJ will need to rely, at least in part, on the NFT community and recognized market experts to alert them of suspicious activity to ensure justice as the utility of NFTs grows.”
